Our table was compiled in summer, 2006
Since then there have been some changes in fees so please check the council's website
A number reduced their fees in the early stages when they found that that they were not going to be swamped.
We have heard of a few, but not many, who have put up their fees.
We still include the 2006 table for interest and comparison.
"You will no doubt be very surprised to learn that South Derbyshire District Council are not charging ANY fee at all. The issue over which department should deal with the new high hedges legislation and what we should charge was discussed with councillors some months ago. With the available information at the time, members felt that the issue was more "nuisance" related and therefore decided to allocate the duties to Environmental Health (rather than Planning which most authorities appear to have done). As it was felt to be a nuisance issue it was considered unfair to charge for the service when a member of the public can complain about neighbours' bonfires / noise etc. without having to pay a penny. This decision was made on the proviso that the charge (or lack of) can be reviewed at any time should the new law become a burden on department resources. However, I would imagine that any charge imposed would be still relatively small in comparison with most other authorities" - Environmental Protection Manager - South Derbyshire District Council.
Very important general notes on what the Government says about fees, and about Government funding at the end of the table.

Q. Do councils have to charge a fee? Q. Has the government set minimum or maximum fees?
Fees
Frequently Asked Questions
A. No. Section 68 of the Anti-social behaviour Act 2003 says that when submitting a
complaint, it must be accompanied by such fee (if any) as the local authority determines.
A. No. Fees are entirely at local authority discretion.
The Government explicitly left Councils to decide.
Please see section 12 of the Regulatory Impact Assessment, which states,
'whether and at what level it is appropriate to charge for this service should rest with local authorities, so that they can take account of local circumstances and local taxpayers' wishes. This would also be in line with the Government's general policy of allowing such decisions to be made at the local level. We will, not therefore, be prescribing a maximum fee'.
Q. Can we claim back the fee from the grower if then case is upheld.
Q. I think that the fee is too high but I am still going to pay. What would I tell the Council
A. Please see our troubleshooting pages, questions & answers 7 and 8
Relevant information on government funding
The Government did make provision for money out of central funding to Councils to be used for the purpose of the High Hedges Law and related appeals. The relevant acts of parliament are Monday 7 April 2003 High Hedges (No. 2) Bill [Money] and Monday 17 November 2003 Anti-social Behaviour Bill [Money] (No. 2). The money is not ring-fenced but it is allowed for in the total amount which is said to have been increased above inflation.
These facts have been carefully checked with the relevant government department.
